Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RealAnalytica platform, website, and related services (collectively, the "Services") provided by RealAnalytica, Inc. ("RealAnalytica," "we," "our," or "us").
By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.
1. Eligibility
You must be at least 18 years old and have the legal authority to enter into this agreement. By registering, you represent that all information you provide is accurate and that you will maintain its accuracy.
2. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to notify RealAnalytica immediately of any unauthorized use or suspected breach of security.
3. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:
- Access or use data not intended for you.
- Attempt to reverse engineer, copy, or modify any part of the platform.
- Use the Services to transmit spam, malware, or unlawful content.
- Misuse MLS or client data obtained through the platform.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
4. Subscription and Payment
If you purchase a paid plan, you agree to pay all applicable fees according to your selected plan's terms.
Fees are non-refundable except as required by law. We may modify pricing or plans with reasonable prior notice.
5. Intellectual Property
All rights, titles, and interests in the Services, including the AI models, predictive algorithms, interface design, trademarks, and content, belong to RealAnalytica or its licensors.
You may not copy, reproduce, or distribute any part of the Services without written permission.
6. Data and Privacy
Your use of the Services is also governed by our Privacy Policy, available at /privacy-policy.
By using the Services, you consent to RealAnalytica's collection and processing of data in accordance with that policy.
7. MLS and Third-Party Integrations
Certain features depend on data and services from MLS providers or third-party vendors.
RealAnalytica is not responsible for interruptions or inaccuracies caused by those external systems.
You agree to comply with all applicable MLS data use policies and licensing requirements.
8. Service Availability and Changes
We may update, suspend, or discontinue parts of the Services at any time.
We will provide reasonable notice for material changes affecting your account or paid plan.
9. Disclaimer of Warranties
The Services are provided "as is" and "as available."
RealAnalytica disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free operation of the Services.
10. Limitation of Liability
To the fullest extent permitted by law, RealAnalytica and its officers, employees, and affiliates are not liable for any indirect, incidental, special, or consequential damages, including data loss or lost profits.
Our total liability for any claim arising under these Terms will not exceed the amount you paid to RealAnalytica in the past twelve (12) months.
11. Termination
You may cancel your account at any time.
We may suspend or terminate your access if you violate these Terms or engage in misuse of the Services.
Upon termination, your right to use the Services ends immediately.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Delaware.
13. Changes to Terms
We may modify these Terms periodically.
Updated Terms will be posted on our website with a revised "Last Updated" date.
Continued use of the Services after changes become effective constitutes acceptance of the new Terms.
14. Data Enrichment, Skip-Tracing, and Outreach Compliance
Certain features of the Services (including, without limitation, the auto-prospect, lead enrichment, and skip-trace tools) surface contact information, public-records data, and compliance metadata sourced from third-party data providers. This data is provided to you on an "as-is" and "as-available" basis, without warranty of any kind regarding accuracy, completeness, currency, or fitness for a particular purpose.
You are solely responsible for the lawful use of any contact information, phone number, email address, or other identifier surfaced through the Services. Without limiting the foregoing, you are responsible for: (a) compliance with the federal Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and its implementing regulations; (b) compliance with the federal Do-Not-Call Registry administered by the FTC and FCC, including any applicable telemarketing exemptions; (c) compliance with state-level "mini-TCPA" statutes and state Do-Not-Call lists; (d) obtaining any prior express written consent required to place autodialed calls, prerecorded calls, or text messages to mobile telephones; and (e) compliance with all applicable federal, state, and local laws governing your outreach, marketing, and communications activities.
The Services may display compliance signals received from third-party providers, including indicators that a phone number appears on a Do-Not-Call list, is associated with a known TCPA litigator, or is otherwise high-risk. These signals are informational only. We do not guarantee that the data displayed is accurate, complete, or current at any given time. You must independently verify, before any contact attempt, whether your intended outreach complies with applicable law and any consent or scrubbing obligations you have.
By accessing or using any data-enrichment, skip-tracing, or contact-discovery feature, you represent and warrant that your use of the resulting data is for a permissible purpose under applicable law, including, where relevant, a permissible purpose under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) and/or the Gramm–Leach–Bliley Act (15 U.S.C. § 6801 et seq.) — for example, a legitimate business need in connection with real estate prospecting, transactions, or relationship management.
You agree to indemnify, defend, and hold harmless RealAnalytica, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, actions, suits, proceedings, losses, damages, penalties, fines, settlements, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of any data, contact information, or compliance metadata obtained through the Services; (ii) any outreach, communication, marketing, or telemarketing activity you conduct using such data; (iii) any alleged or actual violation by you of the TCPA, Do-Not-Call rules, state mini-TCPA statutes, FCRA, GLBA, or any other applicable law; or (iv) any breach by you of the representations and warranties in this Section 14.
Nothing in this Section 14 limits or replaces the disclaimers and limitations set forth in Section 9 (Disclaimer of Warranties) or Section 10 (Limitation of Liability), which continue to apply in full force.
